1. Acceptance of Terms

By accessing and using BlackTide ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

BlackTide is a service provided by HYPER SCALE, S.L.U. ("we," "us," "our"), a company registered in the Principality of Andorra.

2. Description of Service

HYPER SCALE, S.L.U. (trading as "BlackTide") provides uptime monitoring, Web3 monitoring, incident management, and status page services ("the Service"). The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

Provide accurate and complete information when creating an account
Maintain and promptly update your account information
Notify us immediately of any unauthorized use of your account
Not share your account credentials with others

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Transmit any harmful or malicious code
Attempt to gain unauthorized access to the Service or related systems
Interfere with or disrupt the Service or servers
Use the Service for any unlawful or fraudulent purpose

5. Subscription and Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method for the subscription fee. Subscriptions automatically renew unless cancelled before the renewal date.

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described in the Privacy Policy.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by HYPER SCALE, S.L.U. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Service Level Agreement

While we strive to provide reliable service, we do not guarantee uninterrupted access to the Service. We reserve the right to perform maintenance that may temporarily affect service availability.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACKTIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Principality of Andorra, without regard to its conflict of law provisions. Any disputes arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of the courts of Andorra.
